Some apartment stakeholders anticipating ADA pool and spa rules

Multifamily property owners and rental property management companies may be impacted by new pool and spa accessibility requirements under the 2010 Americans with Disabilities Act Standards.

Scheduled to go into effect May 21, UNITS magazine notes these requirements could be delayed by an extension, if the U.S. Department of Justice chooses to issue one. Otherwise, apartments that receive federal assistance or open their pools or spas to the public will be impacted. This includes any who host swim meets or sell pool passes.

The National Apartment Association and the National Multi Housing Council are collaborating to provide guidance on the accessibility requirements, which may prove helpful to landlords and managers. Lawmakers in both houses of Congress have introduced legislation that would prevent enforcement of the new rules, the news source notes. It is not yet clear how far that effort will go, however.

A rule proposed by the House Judiciary Committee might extend the compliance deadline until mid-September, after a subcommittee hearing took issue with the Department of Justice's guidance on the grounds that it did not comply with the Administrative Procedure Act.
